2. Purposes of processing your personal data
Your personal data will be used for the general purpose of managing and controlling the commercial relationship established between the user and the data controller, and specifically for the following purposes:
To manage full access to and proper use of the services and/or products by users.
To communicate with users in response to incidents, requests, comments and questions submitted through the contact forms on our website, including e-mails and/or telephone calls.

We will not process your personal data for any purpose other than those described above, unless required by law or by a judicial and/or administrative request involving the processing of data for purposes other than those stated.
3. Data retention period
The personal data provided will be kept and processed for as long as the contractual or commercial relationship with the user remains in force, without prejudice to the possibility of exercising rights in relation to personal data protection.
The data may also be kept for the time strictly necessary to comply with legal obligations applicable to the data controller.
The personal data of people interested in receiving commercial information and newsletters will be kept for as long as the data subject does not request to object to the sending of commercial communications or request the deletion of their data.
4. Legal basis for processing
METRECUBIC processes your personal data on the following legal bases:
4.1. Consent of the data subject
The consent of the data subject will be requested before processing their data, during the registration or customer contracting process, or when authorising the sending of commercial communications by METRECUBIC.
Requests for information require the user to voluntarily provide the data necessary to respond to them. However, the user may freely refuse to provide such data or subsequently withdraw the consent granted.
In these cases, refusal to provide personal data will make it impossible to respond to the user’s requests, and withdrawal of consent will not affect processing carried out before such withdrawal.
4.2. Performance of a contract or application of pre-contractual measures
The processing of data by METRECUBIC will be necessary for the performance of a contract to which the data subject is a party, or for the application, at their request, of pre-contractual measures.
This legal basis will apply when the user requests information, purchases products or contracts services through our website.
4.3. Legitimate interest
METRECUBIC may process personal data on the basis of its legitimate interest in maintaining and building loyalty among its customers and/or users, better meeting their expectations or previously expressed interests, improving the products and/or services offered, managing requests, queries or complaints, offering products similar to those contracted and informing users of current promotions and discounts.
The above shall apply without prejudice to METRECUBIC’s compliance with all other obligations regarding the sending of commercial communications by electronic means, as regulated by Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce.
5. Accuracy of data
METRECUBIC understands that, by providing us with their personal data, the data subject guarantees and is responsible for the truthfulness, accuracy and up-to-date nature of such data, and expressly accepts and consents to its processing for the purposes described.
If the user provides data relating to other persons, they declare that they have their authorisation and undertake to inform them of the content of this Privacy policy, holding METRECUBIC harmless from any liability in this regard. METRECUBIC may carry out the necessary checks and take appropriate precautions in accordance with current legislation.
6. CVs
If METRECUBIC provides interested parties with a contact form, e-mail address or online platform for sending CVs, the data will be processed for the purpose of involving the interested party in recruitment processes and analysing their profile in order to select candidates for vacant positions.
If CVs are received when there is no vacant position or active recruitment process, they will be deleted and the interested party will be informed of this circumstance. If METRECUBIC is interested in keeping the CV received because it considers the candidate’s profile to be of interest, the interested party will be informed, and the defined retention periods will in all cases be respected.
The legal basis for processing the personal data contained in CVs will be the performance of a contract or the application of pre-contractual measures at the request of the data subject, or the consent of the data subject.
The data will be kept for the duration of the recruitment process and, in any case, for a maximum period of 6 months.
Candidates may exercise their rights of access, rectification, deletion, objection, restriction and portability regarding their personal data in the manner established in this Privacy policy.
7. Recipients of data disclosures and international transfers
As a general rule, METRECUBIC will not disclose your personal data to third parties unless there is a legal obligation, it is necessary for the provision of the contracted services, or the user has expressly authorised it.
Third parties providing services to METRECUBIC as data processors may have access to personal data, provided that the corresponding contracts and guarantees required by applicable regulations have been signed.
METRECUBIC will not carry out international transfers of personal data collected through this website, except in the following cases:
Where the international transfer of data is necessary for the performance of a contract or pre-contractual measures to which the data subject is a party.
Where the international transfer of data is necessary under applicable legislation.
Where the international transfer of data is based on the express consent of the data subject.
Where the international transfer of data takes place because the website is hosted on servers located outside the European Economic Area.
In any case, where international data transfers may take place, METRECUBIC will verify that the importing country guarantees an adequate level of protection in accordance with current regulations.
8. Rights of data subjects

Right of access
This allows the data subject to know and obtain information about their personal data undergoing processing.
Right of rectification
This allows errors to be corrected, inaccurate or incomplete data to be amended, and the accuracy of personal data to be ensured.
Right of deletion
This allows the data subject to request the deletion of personal data when it is no longer necessary for the execution or provision of the service.
Right of objection
This allows the data subject to request that their personal data not be processed or that such processing cease, unless there are legitimate grounds or it is necessary for the exercise or defence of possible claims.

Right not to be subject to automated individual decisions
Data subjects have the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects concerning them or significantly affects them.
Withdrawal of consent
The data subject has the right to withdraw consent at any time when consent is the legal basis for the processing of personal data, without affecting the lawfulness of processing based on consent before its withdrawal.
To exercise any of the above rights, the user may contact METRECUBIC using the contact details indicated in the section “Identity of the data controller”, including the following information:
Full name.
National ID number, NIE, passport or equivalent document.

9. Minors
METRECUBIC recommends the use of this website by persons over 18 years of age.
If minors under 14 years of age access the website, the consent of their parents, guardians or legal representatives will be required in order to process their personal data. Parents, guardians or legal representatives will be solely responsible for the content that the minor may access when visiting our website.
10. Social media
METRECUBIC may have profiles on different social media platforms. It is also possible that the user may access private areas that may exist on this website through their social media accounts, instead of accessing them with a username and password.
In these cases, users who provide their personal data through their social media account or profile are informed that the corresponding social media platform will be responsible for the data processing carried out, unless other conditions are expressly stated for a specific processing activity.
11. Retention of certain data

12. Registered data
Our servers automatically collect information when the user uses the website services. This log data may include the IP address, identification of the device used to access our website, the operating system used and the device settings, among others.
13. Security measures
The user is informed that the owner of the website, as data controller, has implemented the necessary technical and organisational security measures to guarantee the security of personal data and prevent its alteration, loss, processing and/or unauthorised access, taking into account the state of the art, the nature of the data stored and the risks to which it is exposed.
Likewise, METRECUBIC maintains additional measures to strengthen the confidentiality and integrity of personal information, as well as the supervision, control and evaluation of processes to ensure respect for data privacy.
14. Partial nullity
If any of the provisions of this Privacy policy is declared null and void or ineffective by a final decision issued by a competent authority, the remaining provisions shall remain in force and shall not be affected by such declaration of nullity.
15. Confidentiality
The personal data collected by METRECUBIC from the user will be treated confidentially, in accordance with the provisions of current legislation.
